Terms of Sale

Last updated : 7 octobre 2026

Terms applicable to any purchase of a subscription or ad pack on Scenby: prices in euros or US dollars according to the catalogue, without VAT (French VAT exemption scheme, Art. 293 B of the General Tax Code), ad validity periods, waiver of the right of withdrawal, the "delivered or re-issued" guarantee, unpaid invoices, plan changes and cancellation. Version effective as of 7 octobre 2026.

1. Purpose and Parties

These Terms of Sale govern the sale of services between IADEM, a French sole proprietorship, 11B avenue de l’Harmonie, 59650 Villeneuve-d’Ascq, France, SIRET 841 588 601 00028 ("Scenby", "we"), and any individual or legal entity placing an order on https://scenby.com ("the Customer", "you").

Scenby is an AI-assisted video ad studio. The services sold are: monthly or annual subscriptions granting a number of ads per month, ad packs purchased one-off, and the Scenby Studio plan ("Delivered"), in which ads are produced by a Scenby operator.

Any order implies unreserved acceptance of these Terms of Sale, the Terms of Use and the Refund Policy. Acceptance is time-stamped at sign-up and confirmed at checkout. Version in force: 7 octobre 2026.

2. Pricing and Plans

Prices are shown in euros (EUR) for Basic/Pro, or US dollars (USD) for historical contracts, without VAT. IADEM benefits from the French VAT exemption scheme (Article 293 B of the General Tax Code): no VAT is charged; the displayed price is the price paid. Invoices bear the statement "TVA non applicable, art. 293 B du CGI" (VAT not applicable).

Unlimited · standard queue

Subscribers’ credit-based generations outside the bonus have priority. Your unlimited render may therefore take longer during busy periods. One unlimited render at a time, with no render-count quota.

Basic and Pro offers — euro catalogue

An account without a subscription can prepare an idea, prompt and brief. The preparation animation and the “ready to launch” card do not create any media. Image or video generation requires an active subscription; after activation, the Customer resumes the brief and separately confirms the launch and its cost. Payment does not automatically start paid generation.

Basic and Pro include every Studio model, advanced settings, Workflows, Brand Kit, voiceovers, the Creative Strategist and Brand Brain. Images reach 4K and videos 1080p on supported models. Basic includes one brand and one Studio creation at a time; Pro includes unlimited brands and six simultaneous Studio creations, including bonus renders. The ten-member team and video translation are in preparation and are not available features today. Both plans share the same credit volumes. Included tools depend on the plan; Pro bonuses also depend on the selected tier.

Monthly or annual Pro with 10,000 credits per month includes Seedance 2.5 without credit deductions for 10 consecutive days and every Studio image model without deductions for 365 consecutive days. Other Pro tiers include every image model for 30 days, without the Seedance video bonus. Basic includes none of these bonuses. Supported resolutions and settings for each image model are included. Bonuses start after the first confirmed subscription payment in this edition, including the discounted first month; the €1 trial payment does not activate them. Each bonus is granted once per account and model and does not restart on renewal. The subscription and qualifying tier must remain active throughout the bonus. Effective cancellation or replacement interrupts the bonus; scheduled cancellation preserves access during the paid period. Only one unlimited render may be queued or running at a time across all models in Studio and Workflows. Other videos, voiceovers, captions and finishing use the quoted credits. After expiry, a new quote at normal credit pricing requires confirmation. No render-count quota applies to these bonuses. Credit-consuming generations have priority; unlimited renders may wait longer at peak times.

Credit costs are shown before confirmation; no fixed number of videos is guaranteed. Monthly grants are valid for 60 days. Access under earlier subscription editions remains unchanged.

Annual billing is charged in one payment; credits are granted monthly. The amounts above are regular renewal prices. Every Basic and Pro tier, monthly or annual, offers 50% off the first month only to eligible accounts with no previous paid subscription. Monthly billing halves the first invoice, then resumes the regular price. The first annual invoice equals 11.5 times the annual monthly equivalent: one month at half price and eleven months at the regular annual rate; yearly renewal is at the regular price. The discount does not apply to the whole first year. Except for the €1 Pro trial, the personal deadline is set at first eligible access and stored for 24 hours; no new discounted checkout may be opened in the final 31 minutes. Exact totals and renewal prices are shown before acceptance.

€1 Pro 10,000 trial and automatic renewal

The trial is available to eligible new subscribers choosing monthly Pro 10,000. The Customer pays €1 for 48 hours of access and 400 credits in total, valid only during those 48 hours with no rollover. Unlimited bonuses and credit packs are unavailable during the trial. The subscription has no commitment. The Customer can cancel the trial at any time before the 48 hours end in Settings → Billing → Cancel trial, by confirming cancellation in the secure portal, to avoid any subscription charge. Unless cancelled before that deadline, the saved payment method is automatically charged €349.50 after 48 hours for the first subscription month (50% off €699), then €699 each month from the second month. Renewal can then be disabled at any time from the same settings; access remains available until the end of the paid period. After confirmation of the first subscription payment, 10,000 credits are granted and the 10-day Seedance and 365-day image bonuses begin. An unconfirmed payment does not unlock the full allowance or bonuses and trial credits expire on schedule. The trial duration, automatic charge, prices and cancellation option are repeated in the order review before consent and on the payment page.

New euro credit packs require an active subscription: 500 credits for €29, 2,000 for €99, or 5,000 for €229. They do not expire or renew automatically and are consumed after subscription credits. They remain tied to the account. Historical packs retain their original validity period.

Existing subscriptions are not converted automatically: their currency, price and credit allowance remain those of their contract. A new subscription cannot be added while another is active. Existing plan changes use the options available in Billing.

Scenby Pro10 ads$379$3588
Scenby Agency18 ads$599$6108
Scenby Delivered10 ads$990—

Historical contracts may include a volume above the base allowance and a one-time trial grant. Previously granted credits remain attached to the account under their original validity; preparation of a new brief is free, and every new image or video generation requires an active subscription.

Detailed pricing and the features of each plan are available on the Pricing page. Scenby may change its prices; new prices apply only to new subscriptions and renewals, with 30 days' notice by email. A Customer who refuses the new price may cancel before renewal.

3. Ordering and Payment

Orders are placed on the site through the secure checkout page of our provider Stripe. Scenby stores no card data. Payment is due immediately: at subscription for a plan (then at each monthly or annual renewal), and at order for an ad pack.

The contract is formed upon receipt of Stripe's payment confirmation. The corresponding ads are added to the Customer's account within minutes and a confirmation email is sent. The invoice is available from the Billing area of the account.

If synchronization between the payment and the account fails, the Customer contacts contact@scenby.com; the ad balance is corrected upon presentation of the Stripe receipt.

4. Subscriptions, Rollover and Expiry of Ads

A subscription is taken out for one month or one year and is automatically renewed for identical periods. The plan allowance is granted monthly, including when billing is annual.

  • Rollover of unused ads: ads from a subscription month that are not used remain usable for 60 days from their allocation, then expire. The oldest ads are used first.
  • Batch expiry: each batch of ads (monthly allocation, pack, promotional offer) carries its own expiry date, visible in the Billing area. An expired batch is neither refunded nor extended.
  • Cancellation: the Customer may cancel the subscription at any time, free of charge and without giving reasons, from the account (Billing → Manage my subscription, Stripe portal). Cancellation takes effect at the end of the paid period; remaining ads stay usable until their expiry.
  • Renewal notice (Art. L. 215-1 of the French Consumer Code): for annual subscriptions, consumer Customers are informed by email of their right not to renew, no earlier than three months and no later than one month before the renewal date.

Plan changes

  • Upgrade: immediate. The difference is billed pro rata for the remaining period and the additional ads are added right away.
  • Downgrade: takes effect at the next renewal date. No refund is due for the current period.

5. Ad Packs

New euro packs follow Section 2 (no expiry). Historical dollar packs are one-off purchases with no commitment. Ads from those historical packs:

  • Are valid for 90 days from the purchase date, then expire;
  • Are added to any subscription ads and are used after those closest to expiry;
  • Are non-refundable once used (see Section 7);
  • Are tied to the Customer's account and cannot be assigned or transferred.

6. Scenby Studio Plan (Delivered)

The Scenby Studio plan is a done-for-you service: ads are produced by a Scenby operator from the Customer's brief, then delivered to the Customer's workspace.

  • Volume: 10 ads per month, produced by an operator.
  • Revisions: 2 revisions included per ad. Any additional revision is quoted separately or consumes one ad from the quota.
  • Approval: for each delivery, the Customer has 10 days to accept the ad or request a substantiated revision. Absent a response within that period, the ad is deemed accepted (tacit acceptance) and deducted from the quota.
  • Lead times: production times given are indicative; they depend on the completeness of the brief and the material provided by the Customer (product, references, consents).
  • Rollover: Studio ads not ordered within the month are not carried over beyond the rollover period in Section 4.

7. Right of Withdrawal and the "Delivered or Re-issued" Guarantee

Withdrawal

Scenby's services are digital content and services supplied immediately after payment. Under Article L. 221-28, 13° of the French Consumer Code, the 14-day right of withdrawal cannot be exercised once performance has begun with the consumer's prior express consent and express waiver of that right.

This express waiver is collected at checkout, through a checkbox on the Stripe payment page, time-stamped and stored with the order. Without this acceptance, payment cannot be completed.

As a commercial gesture, a Customer who has used no ad may nevertheless request a full refund of the order within 14 days of payment (see the Refund Policy).

Delivered or re-issued

Every ad is owed to the Customer. If a generation fails for a technical reason (engine outage, processing error, timeout), the ad is automatically re-issued to the account, with no action required from the Customer. No re-issue is due when the failure results from content contrary to the acceptable use rules (moderation refusal) or from unusable material supplied by the Customer, as stated in the displayed reason.

The creative outcome of a successful ad (style, rendering, the AI's artistic choices) is not a defect; it gives rise to neither re-issue nor refund, but can be reworked using the studio's revision tools.

8. Unpaid Invoices and Suspension

If a subscription payment fails:

  1. The Customer is notified by email and by a banner in the workspace, inviting them to update their payment method from the Stripe portal. During this grace period, Stripe automatically retries the payment and the service remains accessible.
  2. If the retries fail, the subscription moves to the "unpaid" state: generation features are suspended; the Customer keeps access to already-produced ads and to the Billing area.
  3. Once Stripe's dunning attempts are exhausted, the subscription is cancelled. Unused subscription ads are forfeited; ads from packs remain usable until their expiry.

Service resumes immediately once payment is settled, as long as the subscription has not been cancelled.

9. Invoicing and VAT

An invoice is issued by Stripe for each payment and is available in the Billing area. No VAT is charged: the publisher operates under the French VAT exemption scheme (Article 293 B of the General Tax Code), so prices are invoiced without VAT. Invoices bear the statement "TVA non applicable, art. 293 B du CGI".

Business Customers established outside France are informed that, the publisher being VAT-exempt, no intra-EU VAT number appears on the invoice; it is up to them to assess their own reporting obligations.

10. Personal Data

Order and billing data are processed by Scenby and by Stripe for the performance of the contract and compliance with accounting obligations (retained for 10 years). Full details are set out in the Privacy Policy.

11. Mediation, Governing Law and Disputes

Any complaint is first sent to contact@scenby.com; Scenby replies within 10 business days.

Membership of a consumer mediation scheme is in progress. Under Article L. 612-1 of the French Consumer Code, any consumer is entitled to free recourse to a consumer mediator for the amicable resolution of a dispute. The list of approved mediators is available at economie.gouv.fr/mediation-conso. The details of the appointed mediator will be published here as soon as membership is effective.

The European Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr.

These Terms of Sale are governed by French law. Failing an amicable resolution, the dispute is brought before the competent French courts: for consumer Customers, the court of their place of residence or of the publisher's registered office; for business Customers, the courts of the publisher's registered office.
