Terms of Use

• Scenby / the Service: the platform available at https://scenby.com, published by IADEM, a French sole proprietorship.
• User: any person holding a Scenby account.
• Ad: the Service's unit of consumption — a video ad produced from the material supplied by the User. The ad balance is visible in the Billing area.
• Supplied Content: any material transmitted by the User (product photos, photos or videos of people, texts, voice samples, web page addresses).
• Generated Ad: the video, images, voice and subtitles produced by the Service from the Supplied Content.

These Terms of Use govern access to and use of the Service. Scenby provides the following features, within the limits of the subscribed plan:

• AI video ad studio: creating an ad from a product (photo or web page), an avatar or a cinematic scene
• AI voice-over (brand voice, voice cloning with consent), subtitles and automatic editing
• Revision and touch-up of an existing ad (segment revision, finishing, high-definition master)
• Concept Studio: generation of several ad concepts from a brief, then batch production
• Scenby Studio (Delivered): ads produced by a Scenby operator and delivered to the Customer's workspace

Production relies on artificial intelligence models run by third-party providers listed in the Privacy Policy. Scenby may change, add or remove features at any time without affecting ads already acquired.

Using the Service constitutes full acceptance of these Terms of Use, the Terms of Sale, the Acceptable Use Policy and the Privacy Policy. Acceptance is time-stamped at account creation.

Scenby may amend these Terms. Any material change is notified by email or in the User's workspace at least 15 days before it takes effect; continued use constitutes acceptance. A User who refuses may delete their account (Section 10).

• The Service is reserved for adults (18 or over) acting on their own behalf or on behalf of a business they are authorized to bind.
• Sign-up is by email and password or via "Continue with Google". The email address must be confirmed. Account creation and brief preparation are free, with no free credits. An active subscription is required to generate images or videos; any trial credits are granted after payment for the trial offer.
• The User warrants the accuracy of the information provided and the confidentiality of their login details. Any activity performed from the account is deemed performed by the User.
• One account per person. Creating multiple accounts to accumulate trial ads is prohibited and results in the closure of the accounts concerned.
• Security functions (password change, active sessions, account deletion) are available under Settings → Security.

• Each production uses the number of ads displayed before launch. Nothing is consumed without that display.
• Delivered or re-issued: any ad that fails for a technical reason is automatically re-issued to the account. A moderation refusal is not a technical failure.
• Validity periods, rollover of unused ads and batch expiry are set by the Terms of Sale.
• Ads are tied to the account; they are neither transferable nor convertible into money, except for the refund cases provided in the Refund Policy.
• Generated ads are kept in the User's workspace as long as the account is active. Scenby recommends downloading a copy.

The Service can animate a person from a photo or video and clone a voice. These features may only be used with the prior, explicit and verifiable consent of the person concerned. The User confirms this via a checkbox each time a photo, video or voice sample of a real person is uploaded, and must be able to provide proof to Scenby on request.

The following are strictly prohibited:

• Deepfakes: depicting a real person saying or doing something they did not say or do, without their consent;
• Using the likeness or voice of a non-consenting person, including public figures;
• Any depiction of minors;
• Misleading content: false claims about a product, fake testimonials presented as genuine, unsubstantiated health claims, advertising contrary to consumer law;
• Sexual, hateful, violent or unlawful content, as detailed in the Acceptable Use Policy.

The User is solely responsible for the compliance of their ads with the rules applicable to their distribution (advertising disclosure, image rights, intellectual property, sector-specific rules). Scenby recommends disclosing that an ad was created with AI assistance where the law or the distribution platform requires it.

Supplied Content

The User remains the owner of the Supplied Content and warrants holding the rights required (copyright, trademarks, image rights) to use it in an ad. The User indemnifies Scenby against any third-party claim in this respect.

Generated Ads

Generated Ads belong to the User, to the extent permitted by applicable law, from their production and for all uses, including commercial ones. Scenby claims no rights over these ads and does not use them to train artificial intelligence models.

The User grants Scenby a limited, non-exclusive, worldwide license over the Supplied Content and Generated Ads for the sole purpose of operating the Service: storage, processing by technical providers, display in the User's workspace, support and quality control. This license ends upon deletion of the content or the account, subject to technical backups (30 days) and legal retention obligations.

Any use of an ad by Scenby for public showcase purposes (home page, examples) requires the User's prior written consent.

Service

The Service, its brand, interface, code and creative libraries (styles, hooks, presets) remain the exclusive property of IADEM. Access to the Service grants no right of reproduction, extraction or reverse engineering.

• Scenby strives to provide continuous access to the Service but guarantees no availability; maintenance interruptions or third-party provider outages may occur. Ads affected by a technical incident are re-issued automatically.
• AI-produced results are inherently variable: Scenby does not guarantee that an ad will exactly match the User's intent, nor the commercial performance of its distribution.
• The User reviews each ad before distribution. Scenby is not liable for the use made of it or for the Supplied Content.
• For business Users, Scenby's liability is limited to direct damages and capped at the amounts paid over the last 12 months. Nothing herein limits consumers' statutory rights.

The processing of personal data is described in the Privacy Policy. The User may at any time download their ads from the gallery and request an export of their data (account, history, ads) by writing to contact@scenby.com; the export is provided within 30 days in a common format.

Suspension by Scenby

Scenby may suspend an account, without notice in serious cases, when the User breaches Section 6 or the Acceptable Use Policy, attempts to circumvent the Service's limits, or in the event of non-payment (the "unpaid" state described in the Terms of Sale). The User is informed of the reason by email and may respond. Ads already produced remain downloadable during the suspension, except for unlawful content.

Deletion by the User

The User may delete their account at any time from Settings → Security → Delete my account. Deletion is permanent: ads, Supplied Content and the remaining ad balance are erased, subject to technical backups (30 days) and billing data retained for legal obligations. An active subscription must be cancelled first; no refund is due for the period already started, except as provided in the Refund Policy.

These Terms of Use are governed by French law. Any complaint is sent to contact@scenby.com. Consumers may use free consumer mediation under the conditions described in the Terms of Sale and the Legal Notice. Failing an amicable agreement, the French courts have jurisdiction.
