1. Principle
In accordance with article 6-I-5 of the French Law for Confidence in the Digital Economy (LCEN) and article 16 of the European Digital Services Act (DSA), Scenby provides rights holders and third parties with a procedure to report any allegedly illegal content.
2. What Can You Report?
- Intellectual property infringement: content that reproduces, without authorization, a work protected by copyright, a registered trademark, or a design;
- Right of publicity / image rights infringement: unauthorized use of your face, voice or identity;
- Defamatory or abusive content;
- Clearly illegal content: child sexual abuse material, glorification of terrorism, incitement to hatred, etc.
3. Reporting Procedure
To report content, send an email to contact@scenby.com with the subject "REPORT — [type of violation]" and the following information:
- Your identity (full name, capacity, contact details);
- The exact URL or identifier of the disputed content on Scenby;
- A precise description of the right or provision being violated;
- Evidence of your rights (e.g. INPI/USPTO trademark registration, copyright, assignment contract, ID for image rights);
- A sworn statement attesting to the truthfulness of your report, signed and dated.
Important notice: any abusive or clearly unfounded report may give rise to civil and criminal liability for its author (Article 6.I.4 of the French LCEN — up to one year of imprisonment and a €15,000 fine; equivalent perjury sanctions may apply in other jurisdictions).
4. Report Handling
IADEM undertakes to handle your report diligently:
- Acknowledgement of receipt within 48 business hours;
- Review and decision within 7 business days (24 hours for clearly illegal serious content);
- Appropriate measures: removal of the content, suspension of the author's account, reporting to the competent authorities if necessary;
- Notification of the content author about the report and the actions taken.
5. Counter-Notification
If you are the author of content that was removed following a report and you believe the removal was unjustified, you may file a counter-notification with contact@scenby.com including:
- Your full identity and contact details;
- Identification of the removed content;
- A sworn statement that you believe the removal was made in error;
- Your acceptance of the competent jurisdiction (French courts) for any dispute arising from this counter-notification.
6. Reporting to Authorities
For serious clearly illegal content (terrorism, child sexual abuse material, threats to state security), you can report directly to the French authorities (or your local equivalent):
- PHAROS (French police platform for illegal content): internet-signalement.gouv.fr
- DSA Single Point of Contact (French Digital Services Coordinator — Arcom): see arcom.fr
